Actually, the constitutionality of ba...Hello Felix,<br />Actually, the constitutionality of banning sharia depends very much on who's interpreting the Constitution.<br /><br />In every case in the past where religious practices have been illegal under US law ( the Mormons and Islam's polygamy, and rites under Santeria and Voodoo that most American jurisdictions would classify as felony animal torture) religion has lost out.Sharia definitely falls in that category.<br /><br />I would also bring up that the Smith Act,which placed significant restrictions on communists without banning the American Communist Party outright during the 1950's survived a constitutional challenge in the SCOTUS and is still on the books. Also, moves to ban sharia law in US proceeding, although these initiatives may be found unconstitutional.
