Rep.Steve King ( R-IA) the vice chairman of the House of the House Judiciary Committee’s Subcommittee on Immigration Policy and Enforcement said today on Mike Huckabeew's radio show that he plans to sue the Obama administration to stop the administration's implementation of the president's new executive order calling for selective amnesty for illegal aliens 30 and under.
“I will tell you that — I’m not without experience on this — I’m prepared to bring a suit and seek a court order to stop implementation of this policy,” King said
“I have done it once in the past successfully when then-Governor Tom Vilsack thought he could legislate by executive order — and the case of King vs. Vilsack is in the books. And that individual, by the way, is now the Secretary of Agriculture. I wonder if he’s not counseling the president on his legal proceedings.”
Huckabee followed up, asking King: “You plan to sue this administration for implementing something that you believe should have required legislative process and approval?”
“That is correct,” King replied.
Th eproblem, of course is that such suits take time to percolate through the court system. Hopefuly King ( if he's serious) will start out by asking the courts for an injunction blocking implementation.
This is a major breach of the Separation of Powers clause in the Constitution, and hardly the first one by this president. The real remedy would be impeachment, but unfortunately there isn't time before the election and at any event,the Democrats in the Senate would never vote to impeach President Obama no matter what he did.
